Florida Homicide Charge Classifications

Florida’s homicide statutes, found in Chapter 782 of the Florida Statutes, define four principal charge tiers. The classification that applies depends on the evidence of intent, the circumstances of the death, and the relationship between the parties. Each tier carries a distinct sentencing range, and the difference between them can mean a path to release versus life without parole.

First-Degree Murder

Under Florida Statute 782.04(1)(a), first-degree murder is a capital felony. It covers killings carried out with premeditation and deaths that occur during certain enumerated felonies, including arson, sexual battery, and kidnapping. This is what Florida law calls the felony murder rule: even without direct premeditation, a death connected to one of these felonies can support a first-degree murder charge. The penalty is either death or life imprisonment without the possibility of parole.

Second-Degree Murder

Florida Statute 782.04(2) defines second-degree murder as a killing carried out with a depraved mind but without premeditation. Under certain circumstances, a death occurring during specific enumerated felonies can also qualify. It is a first-degree felony with a maximum sentence of life in prison. When a firearm is involved, Florida’s 10-20-Life sentencing law may impose a mandatory minimum of 25 years.

Third-Degree Murder

Under Florida Statute 782.04(4), third-degree murder involves an unintentional death occurring during the commission of a non-violent felony. It is a second-degree felony carrying a maximum of 15 years in prison and a fine of up to $10,000.

Manslaughter

Florida Statute 782.07 defines manslaughter as the killing of another person without lawful justification through culpable negligence or other unlawful means. It is typically a second-degree felony with a maximum of 15 years in prison. When the victim is a child, elderly person, disabled adult, or an on-duty first responder, the charge is elevated to aggravated manslaughter, a first-degree felony carrying up to 30 years.

• Constitutional violations: Evidence obtained through an unlawful search and seizure or without proper Miranda warnings may be suppressed, removing key elements of the prosecution’s case.
